RECEIVERSHIP SERVICES
ORDER/RULE 11 LANGUAGE
Roger Brissette, a licensed real estate agent, is appointed the Receiver of (property address).
Receiver shall list the property for sale at a price determined by the Receiver.
Receiver shall list the property for sale 'as-is,’ unless otherwise agreed upon by Receiver, Petitioner and Respondent.
Receiver shall receive a 1.5% Receivership Fee at closing; percentage of the gross sale price.
Receiver shall list the property with a 6% Listing Commission.
Receiver shall negotiate the sale of the property and execute the sales contract on behalf of the parties.
Receiver shall ensure the proceeds are distributed according to a Court ORDER setting forth either the parties’ agreed distribution or the distribution determined by the Court.
Receiver will sign all closing/deed documents and ensure delivery to the purchaser.
Receiver shall work with the occupant to ensure showings, but may demand specific times if cooperation is not forthcoming.
Receiver shall not manage rents, mortgage payments, tax payments, HOA payments or utilities on the home, unless otherwise agreed upon by Receiver, Petitioner and Respondent and set forth in a written agreement which shall be incorporated into the Receivership proceedings.
Receiver shall not do repairs to the home, unless otherwise agreed upon by Receiver, Petitioner and Respondent and set forth in a written agreement which shall be incorporated into the Receivership proceedings and set forth in a written agreement which shall be incorporated into the Receivership proceedings.
Receiver shall not take on the responsibilities or obligations of the homeowner, and will not schedule, manage, or pay contractors or repairmen, unless otherwise agreed upon by Receiver, Petitioner and Respondent and set forth in a written agreement which shall be incorporated into the Receivership proceedings.
Any repair, maintenance, staging or other requests by Receiver, that are paid for by Petitioner or Respondent shall be reimbursed to the party who paid the expense, from the net proceeds (defined as after deduction of all closing costs including payment of the Receiver’s fee and listing commission) and before division is made amongst the Parties.
Bond is waived.
